1. General Provisions
These terms of service ("Terms") govern the use of the Düzenal platform ("Platform") operated by yasinburak.com ("Company").
By using the Platform or creating an account, you agree to be bound by these Terms. If you do not accept these Terms, you must not use the Platform.
The Platform is a SaaS (Software as a Service) solution offering AI-powered chatbot, automation, and customer management services.
2. Account Creation and Security
• A valid email address and business information are required to create an account.
• You are responsible for the confidentiality and security of your account credentials.
• You must not share your password with third parties.
• If you detect unauthorized access to your account, you must immediately notify
[email protected].
• Users under 18 years of age may not use the Platform.
• The Company reserves the right to temporarily suspend your account in case of suspected security breaches.
3. Subscription and Payment
• The Platform offers different subscription plans (Starter, Professional, Enterprise).
• Subscription fees are billed monthly or annually.
• The specified discount rate applies for annual payment options.
• Payments are processed securely via Stripe and iyzico infrastructure.
• Invoices are automatically sent to your registered email address.
• If a payment fails, it will be retried within 7 days; after 3 failed attempts, the account may be suspended.
• VAT is added to the invoice amount in accordance with applicable tax legislation.
4. Cancellation and Refund
• You may cancel your subscription at any time.
• Cancellation takes effect at the end of the current billing period; you continue to use the service for the remaining period.
• Annual subscriptions include an unconditional 14-day refund right.
• After the 14-day period, no pro-rata refund is provided for remaining months.
• Your data is retained for 30 days after cancellation; you may reactivate your account during this period.
• After 30 days, all your data is permanently deleted.
5. Acceptable Use
The following rules apply to Platform usage:
You must not:
• Use the Platform for illegal purposes
• Interfere with or disrupt other users' services
• Intentionally exceed API rate limits
• Distribute malware or spam content
• Reverse engineer, decompile, or copy source code
• Create fake accounts
• Use the chatbot to generate misleading, discriminatory, or harmful content
• Attempt unauthorized access to Platform infrastructure
In case of violation, the Company reserves the right to suspend or terminate your account without prior notice.
6. Service Level Agreement (SLA)
• The Platform targets 99.9% annual uptime.
• Scheduled maintenance is communicated at least 48 hours in advance.
• Scheduled maintenance periods are excluded from SLA calculations.
• In case of SLA breach, proportional credit is provided for the affected period.
• Force majeure events (natural disasters, war, infrastructure outages) are excluded from SLA coverage.
7. Intellectual Property
• The Düzenal platform, software, design, logo, and all content are the intellectual property of yasinburak.com.
• A subscription grants you the right to use the Platform; it does not confer ownership rights.
• Content you create through the Platform (chatbot responses, configurations) belongs to you.
• General information generated by AI models is not subject to intellectual property claims.
• When you embed the Platform widget on your site, a "Powered by Düzenal" notice is displayed.
• Your API keys and integration codes are confidential; you are responsible for their safekeeping.
8. Limitation of Liability
• The Platform is provided "as-is".
• The Company does not guarantee the accuracy, completeness, or fitness for a particular purpose of AI chatbot responses.
• Chatbot responses do not replace professional advice (medical, legal, financial).
• The Company's total liability is limited to the subscription fees paid in the last 12 months.
• No liability is accepted for indirect, incidental, or punitive damages.
• Third-party integration terms (WhatsApp, Instagram, etc.) are determined by the respective providers.
9. Data and Privacy
For detailed information on the processing of your personal data, please review our Privacy Policy. In summary:
• Your data is protected under KVKK and GDPR.
• Secure communication is provided via SSL/TLS encryption.
• Your data is never sold for advertising purposes.
• You may exercise your rights under KVKK Article 11 and GDPR Articles 15–22 at any time.
10. Modifications
• The Company reserves the right to modify these Terms with prior notice.
• Significant changes will be communicated via email at least 30 days in advance.
• Continued use of the Platform after modifications constitutes acceptance of the new Terms.
• If you do not accept the changes, you may cancel your subscription.
11. Governing Law and Disputes
• These Terms are governed by the laws of the Republic of Turkey.
• Ankara Courts and Execution Offices have jurisdiction for disputes.
• Consumer Arbitration Boards and Consumer Courts have jurisdiction for disputes within the scope of consumer rights.
• For EU residents, the European Commission's Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) is available.
